TERMS & CONDITIONS (AGB)
1. Scope
These Terms & Conditions govern all business relationships between Travel Protocol Worldwide Maalaoui (“TPWW”), a sole proprietorship registered in Sempach, Switzerland, and its clients.
By requesting a quotation, confirming a booking, making a payment, or using any service provided by TPWW, the client acknowledges and accepts these Terms & Conditions.
2. Scope of Services
Travel Protocol Worldwide (TPWW) is an independent luxury travel agency and concierge company providing tailor-made travel planning, premium hospitality services, and exclusive lifestyle solutions worldwide.
TPWW provides, arranges, sells, coordinates, or facilitates services including but not limited to:
• Luxury Hotel Reservations
• Villas & Private Residences
• Travel Planning & Concierge Services
• Chauffeur & Private Transfers
• Car Rental Services
• Private Aviation
• Yacht Charters
• Security Coordination
• Medical & Wellness Travel
• Lifestyle & VIP Services
Depending on the specific service, TPWW may act either:
a) As the contractual seller in its own name
For selected travel products, accommodation, hotel reservations, car rentals and other travel-related services purchased through TPWW’s contracted suppliers, wholesalers or reservation systems, TPWW acts in its own name and sells such services directly to the client.
OR
b) As an intermediary or coordinator
For services such as Private Aviation, Yacht Charters, Luxury Vehicle Providers, Security Services, Medical Services, Wellness Providers and other specialised third-party services, TPWW acts solely as an intermediary, coordinator or concierge between the client and the independent service provider.
The applicable role of TPWW depends on the respective service booked.
TPWW reserves the right to use carefully selected international suppliers and partners for the execution of services.
While TPWW carefully selects its partners, it cannot guarantee availability, upgrades, operational decisions, weather conditions, governmental restrictions or any circumstances beyond its reasonable control.
3. Conclusion of Contract
A binding agreement is concluded once one of the following occurs:
• Written booking confirmation
• Acceptance of an individual quotation
• Confirmation via Email
• Confirmation via WhatsApp
• Telephone confirmation
• Signed agreement
• Payment of an invoice
• Payment via Payment Link
• Bank Transfer received
All quotations remain subject to availability until confirmed.
Prices, availability and supplier conditions may change until full payment has been received and the booking has been confirmed.
4. Prices & Payment Terms
Unless otherwise agreed in writing, all prices are quoted in Swiss Francs (CHF).
Payment may be made by:
• Bank Transfer
• Secure Payment Link
• Credit Card
• Other approved electronic payment methods accepted by TPWW
Bookings are only considered confirmed after TPWW has received full payment unless otherwise agreed.
The client authorises TPWW to process payments through approved payment service providers.
Any transaction fees charged by banks, payment providers or international card issuers remain the responsibility of the client unless otherwise agreed.
TPWW reserves the right to cancel, postpone or suspend services if payment deadlines are not met.
5. Refunds & Cancellations
Cancellation policies vary depending on the booked service and supplier.
For services sold directly by TPWW, the cancellation conditions stated in the individual quotation, booking confirmation or invoice shall apply.
For services where TPWW acts solely as an intermediary or coordinator, the cancellation and refund policies of the respective supplier or service provider shall apply.
Certain bookings, promotional rates, prepaid reservations or special offers may be fully non-refundable once confirmed.
Any concierge work, planning services, consultation, itinerary preparation or coordination already performed by TPWW remains payable and is non-refundable.
Refunds, if applicable, will only be processed after TPWW has received the corresponding refund from the relevant supplier, where applicable.
5. Liability
TPWW shall only be liable for damages caused intentionally or through gross negligence in connection with its own coordination services.
TPWW assumes no liability for services provided by external partners. Contracts between the client and third-party providers remain unaffected.
Liability for indirect damages, consequential damages, or loss of profit is excluded to the extent permitted by law.
Any liability is limited to the amount of the coordination fee paid to TPWW.
6. Liability
TPWW shall exercise reasonable care and professional diligence in providing its services.
Where TPWW acts as the contractual seller of a service, its liability shall be limited to damages directly caused by TPWW through intentional misconduct or gross negligence, to the extent permitted by applicable law.
Where TPWW acts solely as an intermediary or coordinator, TPWW shall not be liable for the acts, omissions, delays, cancellations, insolvency, operational failures, overbookings, accidents, schedule changes, force majeure events, quality of service, or any other actions of independent third-party suppliers.
TPWW shall not be liable for indirect damages, consequential damages, loss of profits, loss of enjoyment, missed connections, business interruption, or any other financial or economic losses.
The client’s contractual relationship with third-party suppliers remains governed by the supplier’s own contractual terms and conditions where TPWW acts solely as an intermediary.
To the fullest extent permitted by Swiss law, TPWW’s total liability shall never exceed the amount actually paid directly to TPWW for the respective service giving rise to the claim.
7. Confidentiality
TPWW is committed to maintaining the highest level of confidentiality and discretion.
All personal information, travel itineraries, booking details, payment information, business communications and client instructions shall be treated as strictly confidential unless disclosure is required by law or expressly authorised by the client.
This obligation continues even after the business relationship has ended.
8. Data Protection
TPWW processes personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, other relevant international data protection regulations.
Client information is processed exclusively for the purpose of providing requested services, completing reservations, communicating with suppliers, processing payments and complying with legal obligations.
Where necessary, TPWW may share relevant client information with hotels, airlines, transportation providers, payment service providers, insurance companies, medical providers or other partners solely for the purpose of delivering the booked services.
TPWW takes appropriate technical and organisational measures to protect personal data against unauthorised access, disclosure or misuse.
9. Compliance & Right to Refuse Service
TPWW reserves the right to refuse, suspend or terminate any booking or service request without liability if it reasonably believes that:
• applicable laws or regulations may be violated;
• anti-money laundering (AML), sanctions or compliance regulations may be breached;
• fraudulent, misleading or suspicious information has been provided;
• payment cannot be verified;
• the requested service may expose TPWW or its partners to legal, financial or reputational risks.
TPWW further reserves the right to request additional identification, documentation or payment verification before confirming any booking or processing any payment.
10. Payments, Chargebacks & Payment Disputes
TPWW accepts payments via Bank Transfer, Payment Links, Credit Card Payments, and other secure electronic payment methods approved by TPWW.
By completing a payment, the client confirms that they are the authorised holder of the payment method used and authorises TPWW to process the transaction for the agreed services.
The client agrees to contact TPWW directly before initiating any chargeback, payment dispute, or payment reversal with their bank or card issuer.
In the event of a chargeback or payment dispute, TPWW reserves the right to provide all relevant documentation to the payment provider, acquiring bank, card issuer, or any competent financial institution, including but not limited to:
• Booking confirmations
• Invoices
• Payment confirmations
• Signed quotations or agreements
• Email correspondence
• WhatsApp communications
• Travel itineraries
• Supplier confirmations
• Proof of services provided
• Cancellation policies accepted by the client
If a chargeback is determined to be unjustified, TPWW reserves the right to recover the outstanding amount together with any applicable administrative costs, chargeback fees, collection costs, and legal expenses permitted under applicable law.
11. Force Majeure
TPWW shall not be liable for delays, cancellations or failures to perform resulting from events beyond its reasonable control, including but not limited to natural disasters, severe weather, strikes, pandemics, governmental actions, border closures, airline disruptions, political unrest, supplier insolvency, war, terrorism, technical failures or other force majeure events.
12. Jurisdiction & Applicable Law
These Terms & Conditions shall be governed exclusively by the laws of Switzerland.
The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms & Conditions shall be Sempach, Canton of Lucerne, Switzerland, unless mandatory legal provisions provide otherwise.
13. Amendments
TPWW reserves the right to amend these Terms & Conditions at any time.
The version published on the official website of Travel Protocol Worldwide at the time of booking, payment or confirmation of services shall apply.
If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
